1. Acceptance of Terms

These Terms of Service are an agreement between you and Muscled Inc. ("we", "us"), 305 Kelson Avenue North, Grimsby, Ontario L3M 4E8, Canada. By accessing Hire Offshore Development (hireoffshoredevelopment.com), submitting a form, booking a call or opting in to text messages, you accept these terms.

2. Description of Service

Through this website we offer placement of offshore software engineers for your team. The website lets you learn about that offer, answer a few qualification questions, book a strategy call and, if you choose, receive text messages about your request. Any paid engagement is governed by a separate written service agreement between you and Muscled Inc..

3. Your Obligations

You agree to:

• Provide accurate and complete information on our forms
• Only provide a mobile number that you own or are authorized to use
• Use the website in compliance with applicable laws and regulations
• Not use the website for illegal, harmful or abusive purposes
• Respect our intellectual property rights

4. Payment Terms

Use of this website and the strategy call are free. Fees for any engagement are set out in your written service agreement and are due as specified there. Payments are non-refundable unless the service agreement says otherwise in writing.

5. Limitation of Liability

To the fullest extent permitted by law, Muscled Inc. shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill or other intangible losses, resulting from your use of this website.

6. No Guarantee of Results

Case studies and figures on this website describe results achieved for specific clients. They are not a promise of the results you will achieve. Results depend on your business, your market and your own execution.

7. Termination

You may stop using the website at any time and may opt out of text messages at any time by texting STOP. We may suspend or end access to the website for anyone who breaches these terms.

8. Intellectual Property

This website and its content, features and functionality are owned by Muscled Inc. and are protected by copyright, trademark and other intellectual property laws. Client names and logos shown on this website belong to their respective owners.

9. Governing Law and Disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. If a dispute arises, you and we will first try to resolve it in good faith by contacting each other at the details in section 11. Any dispute that cannot be resolved that way will be brought exclusively in the courts of the Province of Ontario, and you consent to their jurisdiction.

10. SMS Terms and Conditions

Program description. Muscled Inc. sends SMS text messages to people who provide their mobile number on a form on this website and tick the consent box. Transactional messages confirm the strategy call you booked, remind you before it starts, and let you reschedule. Marketing and promotional messages about our services are sent only to people who tick the separate, optional marketing consent box.

Message frequency. Message frequency varies. You may receive up to 10 messages per month.

Message and data rates. Message and data rates may apply for messages sent to you from us and to us from you. Contact your wireless carrier for details about your plan.

Opt-out instructions. You can cancel at any time. Text STOP to any message you receive from us to unsubscribe. After you send STOP we will send one confirmation message and you will not receive further messages. To opt in again, submit the form on this website and tick the consent box.

Carrier liability. Carriers are not liable for delayed or undelivered messages.

Age restriction. You must be 18 years of age or older to opt in to our SMS program. By opting in you confirm that you are at least 18 years old and that you are the account holder or have the account holder's permission for the mobile number provided.

Consent. Consent to receive text messages is not a condition of purchasing any goods or services. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Privacy. How we collect, use and protect your mobile information is described in our Privacy Policy.
